00 Enrolled HB 146 01 Relating to proof of motor vehicle liability insurance; and providing for an effective date. 02 _______________ 03 * Section 1. AS 28.22.019(a) is amended to read: 04 (a) A person shall have proof of motor vehicle liability insurance in the 05 person's immediate possession at all times when driving a motor vehicle, and shall 06 present the proof for inspection upon the demand of a peace officer or other authorized 07 representative of the Department of Public Safety. A person may display the proof 08 on a mobile electronic device. However, a person charged with violating this section 09 may not be convicted if the person produces in court or in the office of the arresting or 10 citing officer proof of motor vehicle liability insurance previously issued to the person 11 that was valid at the time of the person's arrest or citation. 12 * Sec. 2. AS 28.22.019(d) is amended to read: 13 (d) In this section, "proof" means 01 (1) a copy of the insurance policy or certificate of self-insurance that is 02 in effect; 03 (2) [OR] a printed card or electronic certification from an insurance 04 company, insurance agent, insurance broker, or surplus lines broker that a policy that 05 complies with AS 28.22.011 is in effect; or 06 (3) the display on a mobile electronic device of verification from an 07 insurance company, insurance agent, insurance broker, or surplus lines broker 08 that a policy that complies with AS 28.22.011 is in effect. 09 * Sec. 3. AS 28.22.019 is amended by adding a new subsection to read: 10 (e) Displaying proof of motor vehicle liability insurance on a mobile 11 electronic device under this section does not constitute consent for a peace officer or 12 other authorized representative of the Department of Public Safety to access other 13 contents of the mobile electronic device. 14 * Sec. 4. This Act takes effect July 1, 2013.
