00                             HOUSE BILL NO. 301                                                                          
01 "An Act relating to partial-birth abortions."                                                                           
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 18.16.050(c) is amended to read:                                                                   
04            (c)  In this section,                                                                                        
05                 (1)  "partial-birth abortion" means a procedure in which a person                               
06       deliberately and intentionally                                                                                
07                      (A)  [AN ABORTION IN WHICH THE PERSON                                                          
08            PERFORMING THE ABORTION] partially vaginally delivers a living fetus                                         
09            for the purpose of performing an overt act that the person knows will kill                               
10            the fetus; and                                                                                           
11                      (B)  performs the overt act, other than completion of                                          
12            delivery, that kills the fetus;                                                                          
13                 (2)  "partially vaginally delivers" means brings about the delivery                                 
14       of a fetus through the mother's vagina that causes                                                            
15                      (A)  in the case of a head-first presentation, the entire fetal                                
01            head to be outside of the mother's body; or                                                              
02                      (B)  in the case of breech presentation, any part of the fetal                                 
03            trunk past the navel to be outside the mother's body [BEFORE KILLING                                     
04            THE FETUS AND COMPLETING THE DELIVERY].
