00                             HOUSE BILL NO. 4001                                                                         
01 "An Act prohibiting the commissioner of administration from drafting, adopting, filing,                                 
02 or publishing regulations granting or extending employment-related benefits for same-                                   
03 sex partners of unmarried state employees; and providing for an effective date."                                        
04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
05    * Section 1.  AS 44.21 is amended by adding a new section to read:                                                 
06            Sec. 44.21.015. Regulations prohibited. (a) Notwithstanding any other                                      
07       provision of law, the commissioner of administration may not draft, adopt, file with                              
08       the lieutenant governor, or publish regulations granting or extending employment-                                 
09       related benefits for same-sex partners of unmarried state employees. Employment-                                  
10       related benefits for same-sex partners of unmarried state employees may only be                                   
11       granted or extended by statute.                                                                                   
12            (b)  Violation of (a) of this section is a class B misdemeanor.                                              
13    * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to                          
14 read:                                                                                                                   
01       RETROACTIVITY. AS 44.21.015(a), added by sec. 1 of this Act, is retroactive to                                    
02 June 1, 2006.                                                                                                           
03    * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
